We use the Personal Information you provide through this website to assess your credit and your credit application, and approve or decline your credit application. We may use your Personal Information in the normal course of providing our services to you, including credit applications, responding to inquiries from you or from third parties to the extent related to your credit application, and providing technical support.
We may share your Personal Information with credit bureaus and/or any related business entity to secure credit information. If we decline your application, you acknowledge and agree that we may forward your credit application to unaffiliated third party lenders for their review and possible approval, and you affirmatively consent to our taking these actions on your behalf. An unaffiliated third party lender may approve or decline your credit application in its sole and absolute discretion. You release FTL from any liability arising from the review by an unaffiliated third party lender of your Personal Information in connection with your credit application, and from FTL’s or an unaffiliated third party’s decision to approve or decline your credit application. We do not share your Personal Information with any third parties for marketing or solicitation purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. You acknowledge that we may receive inquiries on the status of your credit application from third parties who may provide products or services to you and who, accordingly, have a legitimate business interest in the status of your credit application. If we receive such inquiries, you expressly permit us to disclose to such third party providers, the status of your credit application and whether financing will be provided by FTL or by a third party lender to whom we submitted your credit application. You acknowledge and agree that we may use and share your Personal Information as described in this Privacy Policy, including with unaffiliated third party lenders and product and service providers who have a legitimate business interest in the status of your credit application. We do not share your Personal Information with any third parties for marketing or solicitation purposes. You may opt-out of having your Personal Information shared with unaffiliated third party lenders as provided in “Right to Opt-Out and Update”.
We collect non-personally identifiable information in the aggregated form that, by itself, does not allow an individual to be identified (“Non-Personal Information”) through the use of General Tracking Information and Click Path Tracking (cookie technology) described below.
Our web server automatically tracks pages visited by our users and collects some user information such as your IP address. Your IP address is a number that is used by computers connected to the Internet to identify your computer so that data (such as the web pages you request) can be sent to you. FTL may change the terms of this Privacy Policy in its sole discretion from time to time, and will update the date of this Privacy Policy accordingly. You may request that we cease sharing your Personal Information with unaffiliated third party lenders by notifying us of your desire to opt-out of this service. In addition, you may choose to limit the type of information or requests received from us. All such requests must be sent to: support@ftlfinance.com. We will have up to 30 days to process your request. You may also update your Personal Information at any time through the registration portal.
If you are a California resident the California Consumer Privacy Act (CCPA) applies to you. The CCPA requires Privacy Policies to include the following information categories relevant to Personal Information we have collected and used during the preceding 12 months (collectively, the “Personal Information Categories”): (1) the categories of Personal information we collected about you, (2) the categories of sources from which your Personal Information was collected, (3) the business purpose(s) for which we collected your Personal Information, and (4) the categories of third parties with whom we have shared your Personal Information These Personal Information Categories are covered in the following sections of this Privacy Policy: “How We Collect Your Personal Information”, “How We Use Your Personal Information”, and “How We Share Your Personal Information”. These Privacy Policy sections will be updated once every twelve months to reflect any changes to these Personal Information Categories. We do not share your Personal Information with any third parties for marketing or solicitation purposes.
In addition to the foregoing, if you are a California resident, you may request that we disclose to you how your Personal Information was applied to each of the Personal Information Categories during the preceding 12 months. You may request disclosure of this information twice during any 12 month period by contacting support@ftlfinance.com or by 800.981.9032 calling. We will provide you with the Personal Information Categories as applicable to your Personal Information within 45 days of any verifiable request, provided, that we reserve the right to extend this period for an additional 45 days if necessary to verify your information and the veracity of your request. We will notify you of any such extension prior to the end of the initial 45 day period. The information will be provided to you at no cost either by mail or electronically.
In addition to your right to opt-out from having your Personal Information shared with third parties, you may also request that we delete from our database any Personal Information that we have collected about you. We will not, however, be obligated to comply with your deletion request if our retention of your Personal Information is necessary for us to comply with any of the following:
(a) provide you with a good or service you have requested, or to complete a particular transaction in process for which your Personal Information was collected, or to otherwise perform a contract entered into between us;
(b) detect a security incident, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

(d) exercise free speech, ensure the right of another customer or consumer to exercise his or her right of free speech, or exercise another right provided for by law;
(e) comply with the California Electronic Communications Privacy Act;
(f) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, whereby our deletion of your Personal Information is likely to render impossible or seriously impair the achievement of such research, as long as you have provided your consent;
(g) necessary for our internal business operations that are reasonably aligned with your expectations and our business relationship;
(h) comply with a legal obligation; or
(i) use your Personal Information internally, in a lawful manner that is compatible with the context in which you have provided us with the Personal Information.
